Introduction
These Terms of Use of FanYield (the "Terms"), and any applicable Supplemental Terms as defined below, form a binding agreement between users ("User" or "You") and FanYield s.r.o., Company ID (IČO): 21484732, registered share capital: CZK 102,000, data box ID: 2m3a5pe, registered office at Školská 660/3, Nové Město, 110 00 Prague 1, Czech Republic, registered in the Commercial Register maintained by the Municipal Court in Prague under file no. [court file number to confirm] ("FanYield" or "We"), governing access to and use of the FanYield sports entertainment platform, including the FanYield website at https://fanyield.io/ (and any successor URLs) and the FanYield mobile application available through the Apple App Store (together, the "Platform").
Please read these Terms carefully. By accessing or using the Platform, You confirm that You accept and agree to be bound by these Terms and any applicable Supplemental Terms, which together form a legally binding contract between You (and any related parties such as Your authorized successors, assignees and beneficiaries) and FanYield (the "Agreement") for the duration the Platform is operated, unless otherwise stated herein or before conclusion of the Agreement. The Agreement constitutes the entire agreement between You and FanYield in relation to its subject matter and supersedes any prior or contemporaneous agreement, understanding or arrangement. If any provision of this Agreement is held invalid or unenforceable, that invalidity or unenforceability shall not affect the validity or enforceability of the remaining provisions or of the Agreement as a whole.
FanYield is a free-to-play, skill-based fantasy sports entertainment platform. Users may collect and manage in-platform digital player cards featuring professional football players ("Collectibles"), assemble fantasy lineups, participate in fantasy tournaments and duels, use closed-loop virtual credits called FanBux, and receive in-platform or non-cash promotional rewards.
FanYield does not provide betting, gambling, wagering, casino, lottery, e-money, wallet, payment account, investment, financial instrument, money transfer, remittance, or cash-out services. Users do not place bets on the outcome of sporting events and cannot withdraw, redeem, exchange, sell back or convert FanBux, Collectibles, rewards, rankings or any in-platform balance into fiat currency, cash or cash equivalents.
The outcome of FanYield fantasy tournaments and duels is based on user decisions, football knowledge, lineup selection, player selection strategy and the real-world sporting performance of football players according to FanYield's pre-defined scoring rules.
Purchasing FanBux, subscribing to FanYield, holding more FanBux, or acquiring higher-priced Collectibles does not guarantee better results, higher ranking, ELO rating, FanBux rewards or any promotional prize.
We store and use personal data in accordance with our Privacy Policy. Depending on how You use the Platform, additional terms may apply ("Supplemental Terms"), including:
the FanYield Marketplace Rules, if You place a sell order or a buy offer for a Collectible;
the Fantasy Rules (as defined in Section 12), if You enter a fantasy tournament or Duel;
the Brand Guidelines, if You use any FanYield trademarks or brand assets.
FanYield maintains a Support Center on the Platform with guides and articles. Support Center materials are informational only and not legally binding.
Key Definitions
For the purposes of these Terms:
"FanBux" means closed-loop virtual credits used only within the FanYield Services. FanBux have no monetary value, are not fiat currency, are not e-money, are not a deposit, are not a wallet balance, are not a financial instrument and cannot be withdrawn, redeemed, exchanged or converted into cash or fiat currency.
"Collectibles" means digital player cards issued by FanYield within the Platform.
"Draft Pack" means an in-platform pack providing a User with a series of player selection choices, as described in Section 6.
"Draft Choice" means a single player selection step within a Draft Pack.
"Collectible Issuance Pool" means FanYield's internal mechanism for issuing, allocating and managing Collectibles within the Services, as described in Section 7.
"Marketplace" means the FanYield in-platform venue where Users may list and acquire Collectibles from other Users, as described in Section 9.
"Tournaments" means free-to-play, skill-based fantasy sports contests offered through the Platform, as described in Section 12.
"Duels" means one-on-one fantasy sports contests between Users, based on the real-world performance of selected football players according to FanYield's pre-defined scoring rules, as described in Section 13.
"Loan Players" means temporary in-platform player access made available by FanYield for selected Tournaments, Duels or other gameplay features, allowing Users to create lineups without necessarily acquiring Collectibles.
"Promotional Rewards" means non-cash rewards that may be awarded in connection with Tournaments, leaderboards, Duels, campaigns or promotions, including physical items, vouchers, partner products, digital goods or other non-cash benefits. Promotional Rewards do not include cash, fiat currency or any right to cash-out.
"Subscription" means a paid access plan that may provide Users with certain convenience features, access benefits, Duel participation benefits, monthly in-platform benefits, or other non-cash digital benefits described on the Platform from time to time.
"Mobile Money" means mobile money payment services offered by mobile network operators or payment providers in supported territories, including Ghana.
"Ghana Payment Collection Entity" means SP Invest Manufacturing Ltd, ORC CS212170925, TIN C0066174228, with its registered office at House Number G12, Boundary Road, Takako Courts 1, East Legon, Accra, Greater Accra, Ghana, digital address G4-376-8324, which acts as the local payment collection, tax handling and settlement support entity in Ghana for certain payments related to the FanYield Services.
"Services" means all products, offerings, fantasy sports features, contests, promotions and functionality of the Platform, including the Marketplace, Tournaments, Duels, FanBux, Collectibles, Draft Packs, Subscriptions and Promotional Rewards.
1. The FanYield Platform
1.1. The Platform and Services are owned and provided to Users by FanYield.
1.2. The Services include all products, offerings, fantasy sports features, contests, promotions and functionality made available through the Platform, including Tournaments, Duels, the Marketplace, FanBux and Subscriptions. Through the Platform, You may obtain, collect, exchange and use Collectibles to participate in Tournaments and Duels and compete with other Users.
1.3. The Platform may contain links to, or content from, services not operated by FanYield, providing additional content or functionality, such as:
payment services — currently Stripe and, for Ghana Mobile Money, pawaPay;
player data and performance statistics — currently SportMonks;
(together, "Third-Party Services").
FanYield reserves the right to change or add Third-Party Services providers at any time. The current list of providers is available in the Support Center.
Whether or not integrated into the Platform, Third-Party Services are provided subject to the terms of use and privacy policies of the relevant third-party provider, under that provider's sole responsibility. FanYield is not responsible for the availability or accuracy of Third-Party Services, nor for the services, products or content available through them. Please consult the terms and privacy policies of the relevant third party for further information.
2. Account
2.1. Account Creation
The FanYield Platform is free to use. To register an account, You must provide:
name;
surname;
email address.
Alternatively, You may create an account via Your Google account.
By creating an account, You agree to these Terms and represent and warrant that: (i) You are at least eighteen (18) years of age; (ii) You agree to these Terms; (iii) You will use the Platform and Services in accordance with these Terms and any applicable laws, rules and regulations; (iv) You are not located in a country subject to a European Union or United Nations embargo, and are not listed on any EU or UN restricted-persons list (including the EU consolidated list of persons subject to financial sanctions). For the avoidance of doubt, You may not access or attempt to access the Platform or Services from any embargoed country or while listed on any such restricted-persons list.
2.2. Account Use
The Platform, accounts and Services are provided for individual, non-commercial, personal use. You may not register on behalf of another person or act in coordination with any other person, group or company.
2.3. Username
Upon account creation, You will be assigned a username associated with Your purchases and Tournament participation.
2.4. Account Security
2.4.1. Do not share Your account information with third parties. Follow security best practices, including using a strong password, a password manager, and safely storing Your information. FanYield is not responsible for loss or theft of Your password or other account information. You are responsible for actions taken under Your account, including by any person using it without Your prior consent.
2.4.2. You agree to report any potential theft of Your credentials, unauthorized access or fraudulent use of Your account to our support team at [email protected] as soon as reasonably possible.
2.5. Prohibited Account Use
2.5.1. Multiple accounts. You may not create more than one account or manage other Users' accounts (even with their express permission). Only a natural person may create an account; partnerships, joint ventures and corporate accounts are prohibited.
2.5.2. Account association. You may not collaborate or act in concert with other accounts, formally or informally, to circumvent these Terms, gain unfair competitive or artificial advantage in Tournaments or Duels, or unfairly or artificially influence Collectible prices — including by coordinating account activity, lending, trading, repeat-buying or reselling Collectibles below market value.
2.5.3. Account recreation. You may not create a new account if Your previous account has been temporarily suspended or permanently deleted.
3. FanBux
3.1. Nature of FanBux
FanBux are closed-loop virtual credits used only within the FanYield Services. FanBux are provided for personal entertainment and in-platform utility purposes only.
FanBux do not represent real currency, fiat currency, e-money, electronic money, a deposit, a wallet balance, a payment account, a financial instrument, a security, a stored value product, a betting stake, gambling winnings, or any claim against FanYield or any third party for money or monetary value.
FanBux cannot be withdrawn, redeemed, refunded, exchanged, sold back to FanYield, converted into fiat currency, transferred outside the FanYield Services, or used as a means of payment outside FanYield.
3.2. Limited License to Use FanBux
FanBux provide Users only with a limited, personal, non-transferable, non-sublicensable, revocable license to use FanBux within the FanYield Services in the ways permitted by FanYield from time to time.
FanYield may revoke, suspend, limit or adjust a User's FanBux balance if the User breaches these Terms, abuses the Services, engages in fraud, creates multiple accounts, manipulates contests or the Marketplace, abuses referrals, initiates abusive chargebacks, or otherwise violates applicable rules.
3.3. How FanBux May Be Obtained
FanBux may be obtained through methods made available by FanYield, which may include: (a) purchase from FanYield through available payment methods; (b) rewards from free-to-play Tournaments; (c) FanBux awarded from Duels; (d) referral promotions or other promotional campaigns; (e) monthly or periodic Subscription benefits; (f) selling or exchanging Collectibles through the Marketplace; (g) other free or promotional methods made available by FanYield.
The availability of any method of obtaining FanBux may change at any time.
3.4. Use of FanBux
FanBux may be used only inside the FanYield Services, including, where available, to acquire Draft Packs, access selected in-platform features, acquire Collectibles from other Users on the Marketplace, participate in Duels, or use other features made available by FanYield.
FanBux may not be sold, purchased, exchanged, transferred or traded outside the FanYield Services. FanYield does not recognize or support third-party services that enable the trading, sale, exchange or transfer of FanBux.
3.5. FanBux Awards in Duels and Tournaments
FanBux may be awarded to Users based on their performance in Duels, Tournaments, leaderboards or promotional campaigns. Such FanBux awards remain closed-loop virtual credits only and do not constitute cash, cash equivalents, gambling winnings, betting winnings, e-money, financial value, or any right to withdrawal or redemption.
A Duel may require the use of FanBux as an internal in-platform participation credit. Unless otherwise specified in the applicable Duel rules, a standard Duel may require one (1) FanBux to participate and may award two (2) FanBux to the winner. Any FanBux awarded in a Duel remain FanBux only and cannot be cashed out or converted into money.
3.6. FanBux Do Not Determine Ranking or Prizes
A User's FanBux balance, purchase of FanBux, use of FanBux, Subscription status, or acquisition of higher-priced Collectibles does not determine the User's ELO rating, leaderboard position, Tournament ranking or entitlement to any Promotional Reward.
ELO rating and rankings are determined by fantasy sports performance, Duel outcomes, lineup decisions, football knowledge, player selection strategy and real-world player performance according to FanYield's pre-defined scoring rules.
Purchasing FanBux or acquiring more expensive Collectibles does not guarantee better player performance, better fantasy results, higher ELO rating, higher ranking or any prize. Users may achieve better results through skillful selection of lower-priced, less popular or undervalued players.
3.7. No Refunds
Except where required by applicable law, all FanBux purchases are final and non-refundable. Because FanBux are closed-loop virtual credits usable only within the FanYield Services, unused FanBux cannot be redeemed for cash or refunded upon account deletion, suspension, termination or discontinuation of the Services.
3.8. Changes to FanBux
FanYield may modify FanBux features, pricing, availability, limits, use cases or rules at any time, provided that such changes do not create any right for Users to cash-out, redeem or convert FanBux into money.
4. Services
4.1. License Grant
Subject to Your acceptance of these Terms and any applicable Supplemental Terms, FanYield grants You a limited, non-exclusive, non-transferable, non-sublicensable, revocable, personal license to use the Services for personal and non-commercial purposes in accordance with these Terms. The license is granted only for the duration the Platform is operated.
5. Collectibles
5.1. Collectibles
Collectibles are unique digital cards featuring professional athletes issued by FanYield s.r.o. through the Collectible Issuance Pool. FanYield ensures the scarcity of Collectibles and the transparency of the Services.
5.2. Rarity
Collectibles have rarity levels defined for each football competition.
Czech Chance Liga / Fortuna Liga: maximum 20,000 shares per Collectible, scarcity maintained by the Collectible Issuance Pool.
English Premier League: maximum 20,000 shares per Collectible, scarcity maintained by the Collectible Issuance Pool.
Additional competitions may be added by FanYield and disclosed on the Platform.
5.3. No Investment Purpose
Collectibles are in-platform entertainment features only. They are the digital equivalent of paper sports collectible cards. They are not sold for investment purposes or with any expectation of profit, financial return or cash-out, although Collectibles may be resold among Users through the Marketplace.
5.4. Issuance Pool Rewards
FanYield may award holders of Collectibles by crediting FanBux to their balance based on the real-world performance of the relevant players ("Rewards"). Rewards are not guaranteed and may vary depending on Issuance Pool conditions.
5.5. Reward Settlement
Following the occurrence of a Reward Event, Rewards will be credited to the FanBux balance within 24 hours of the conclusion of the relevant Tournament. If a delay in receiving data from third parties prevents the Services from processing Rewards in that timeframe, Rewards will be credited at 04:00 CET on the next day after data is received.
5.6. Reward Amount
The Reward Amount is the FanBux amount credited to the User's balance based on the FanBux allocation set for the relevant Tournament.
5.7. Ownership
When You acquire a Collectible, You receive the in-platform rights to hold, use and transfer that Collectible within the Services in accordance with these Terms ("Collectible Holder"). Unless expressly stated otherwise, You may use Your Collectible in Tournaments and Duels and transfer it through the Marketplace in accordance with these Terms.
5.8. Collectible Elements and Third-Party Rights
Player photographs, club logos (including trademarks and kits) and other elements appearing on Collectibles may be officially licensed from the relevant third-party rights holder ("Third-Party Collectible Elements").
5.9. License Restrictions
Without FanYield's prior written consent, You may not, whether or not You own the Collectible: (i) use the Collectible or any Third-Party Collectible Element for commercial purposes, advertising or promotion of any third-party product or service; (ii) trade derivatives or merchandise representing the Collectible, physically or digitally; (iii) modify the Collectible image or Third-Party Collectible Elements; (iv) assert any additional intellectual property rights in relation to the Collectible or Third-Party Collectible Elements; (v) violate any applicable third-party right; (vi) use Third-Party Collectible Elements or the Collectible in connection with media that depicts hate, intolerance, violence, cruelty, or anything that could constitute hate speech, defamation, or otherwise infringe the rights of others, including the image rights of the player depicted; (vii) trade, distribute for profit (including without payment with intent of future profit), or engage in any commercial activity involving merchandise containing or composed of Third-Party Collectible Elements.
6. Draft Packs and Collectible Release
Upon initial issuance of Collectibles, Users may obtain access to a fantasy player draft feature through in-platform packs ("Draft Packs"). A Draft Pack provides Users with a series of player selection choices ("Draft Choices").
In the standard Draft Pack format, a User is presented with three (3) draft rounds. In each round, the User chooses one (1) player from three (3) available options. This means the User actively selects three (3) players from a total of nine (9) offered player options.
Draft Packs are an in-platform fantasy player selection feature. They are not a lottery, casino product, gambling product, betting product, financial product, investment product, cash prize product or cash-out product. Draft Packs do not provide cash, fiat currency, cash equivalents, e-money, financial instruments, or any right to withdraw, redeem or convert any item into money.
The future real-world performance of any player selected through a Draft Pack is uncertain. Selecting a player, acquiring a Collectible, or acquiring a higher-priced player does not guarantee any fantasy result, ranking, ELO rating, FanBux award or Promotional Reward.
6.1. Payment for Draft Packs
Where Draft Packs are available for purchase, the price is deducted from the User's FanBux balance.
6.2. Service Interruptions
If a service disruption or technical issue beyond FanYield's reasonable control prevents a User from opening a Draft Pack or completing Draft Choices, any denied or interrupted Draft Choices will be made available once the issue is resolved, where technically and commercially reasonable.
7. Collectible Issuance Pool
Any reference to an issuance pool, IPO Pool or Collectible pool within the FanYield Services refers only to FanYield's internal mechanism for issuing, allocating and managing Collectibles within the Services.
Such pool is not a bank account, deposit account, investment fund, financial pool, betting pool, prize pool, user wallet, segregated client account or account held on behalf of Users.
Users do not acquire any right, title, interest or claim to any bank account, payment account, funds, revenues or proceeds received by FanYield, its payment processors or its local collection entities. Users receive only the relevant in-platform rights expressly described in these Terms.
8. Exchange of Collectibles
8.1. Through the Marketplace
You may sell Your Collectibles to other Users, or buy Collectibles from other Users, by placing an order on the FanYield Marketplace. FanYield may, at its sole discretion, restrict Your ability to use the Marketplace from time to time. Use of the Marketplace is subject to Section 9.
8.2. Disclaimer
To the fullest extent permitted by applicable law, FanYield, its agents, officers, consultants, contractors, shareholders, employees, successors, directors, partners, subsidiaries, suppliers and licensors shall not be liable for any loss or damage that may occur during the sale or exchange of Collectibles through the Marketplace.
9. Marketplace
9.1. Marketplace
FanYield operates as an intermediary connecting buyers and sellers of Collectibles ("FanYield Marketplace" or "Marketplace"). The Marketplace is driven by supply and demand. FanYield does not use trading algorithms or other mechanisms to influence prices or fluctuations of Collectibles. Once Collectibles are acquired from the Collectible Issuance Pool and held by Users, their in-platform prices are determined by supply and demand.
9.1.1. The Marketplace allows Users to buy, sell and place orders on Collectibles using FanBux.
9.1.2. The Marketplace functions as a Collectible exchange enabling Users to trade Collectibles directly with each other. FanYield acts only as intermediary and assumes no responsibility for transactions concluded on the Marketplace.
9.1.3. In-platform prices on the Marketplace are determined exclusively by supply and demand. Users are responsible for their own decisions and actions on the Marketplace.
9.1.4. FanYield bears no responsibility for disputes, disagreements or issues arising from Marketplace transactions. Users are encouraged to act with caution and good judgment.
9.1.5. The Marketplace may be subject to technical difficulties such as server outages or delays that may prevent Users from completing trades. FanYield is not responsible for any such technical issues, and it is the User's responsibility to ensure that their device and internet connection function properly before participating in Marketplace activity.
9.1.6. FanYield is not responsible for errors, defects or loss of FanBux, Collectibles or other in-platform items caused by the order system. Users acknowledge and agree that use of the Marketplace is at their own risk.
9.5. Marketplace Trading Hours
Trading is scheduled from 04:00 to 03:00 (CET), seven days a week (Monday through Sunday). FanYield reserves the right to change, update or modify the trading-hours structure at any time at its sole discretion.
10. Payments
10.1. Paid Services
FanYield may allow Users to make payments for selected digital Services, including FanBux, Draft Packs, Subscription plans, or other in-platform digital features made available from time to time.
Paid Services are provided for personal entertainment and in-platform use only. Payments to FanYield do not constitute deposits, betting stakes, gambling stakes, wallet top-ups, financial investments, money transfers, remittances, or purchases of cash-out rights.
10.2. Available Payment Methods
FanYield may make different payment methods available depending on the User's location, currency, product, platform, technical availability, payment provider availability and compliance requirements.
Available payment methods may include card payments, bank transfer, Mobile Money, payment service providers, or other methods shown at checkout.
10.3. Ghana Mobile Money Payments
For Users located in Ghana, payments for FanYield Subscriptions, FanBux, Draft Packs and other digital Services may be collected in Ghanaian Cedi (GHS) through Mobile Money.
Such payments may be processed through pawaPay or other payment processing providers and collected by SP Invest Manufacturing Ltd, ORC CS212170925, TIN C0066174228, with its registered office at House Number G12, Boundary Road, Takako Courts 1, East Legon, Accra, Greater Accra, Ghana, digital address G4-376-8324, acting as the local payment collection, tax handling and settlement support entity in Ghana for the FanYield service provider.
Payment made to SP Invest Manufacturing Ltd for FanYield Services shall be deemed payment to FanYield for the relevant Subscription, FanBux purchase, Draft Pack or other digital Service.
10.4. Ghana Taxes and Indirect Taxes
Amounts charged to Users located in Ghana may be charged in GHS together with applicable Ghanaian VAT or other indirect taxes, unless the checkout page states that the displayed price already includes such taxes.
Where applicable under Ghanaian tax law and FanYield's local tax structure, applicable Ghanaian VAT or other indirect taxes may be charged on Ghana transactions and handled through SP Invest Manufacturing Ltd or another relevant local tax mechanism in accordance with applicable Ghanaian tax laws and the commercial arrangement with FanYield.
10.5. Role of SP Invest Manufacturing Ltd
SP Invest Manufacturing Ltd does not operate the FanYield Platform and does not provide Tournaments, Duels, FanBux, Collectibles, Subscriptions, Promotional Rewards or customer support related to the FanYield Services.
SP Invest Manufacturing Ltd acts only as a local payment collection, tax handling and settlement support entity in Ghana. SP Invest Manufacturing Ltd does not provide betting, gambling, wagering, casino, lottery, wallet, e-money, payment account, remittance, money transfer or cash-out services in connection with FanYield.
SP Invest Manufacturing Ltd does not hold funds on behalf of Users. Amounts collected by SP Invest Manufacturing Ltd relate only to payment collection for FanYield digital Services and are not user deposits, betting stakes, gambling stakes, wallet balances or withdrawable funds.
10.6. Payment Processors and Mobile Network Operators
Payment processors, Mobile Money operators, mobile network operators and other payment service providers involved in a payment transaction act only as technical payment processing parties. They do not operate FanYield, do not determine contest results, do not issue FanBux, do not provide cash-out, and are not responsible for FanYield accounts, gameplay, rewards, Subscriptions or customer support.
10.7. Refunds and Failed Payments
Except where required by applicable law, payments for FanBux, Draft Packs, Subscription plans and other digital Services are final and non-refundable once the relevant digital Service, FanBux, Draft Pack, Subscription benefit or in-platform item has been made available to the User.
If a payment fails, is reversed, charged back, refunded, cancelled, suspected as fraudulent, or otherwise not settled, FanYield may suspend or reverse the corresponding FanBux, Draft Pack, Subscription benefit, Collectible, access right or other in-platform benefit.
10.8. Taxes, Fees and Currency
Users are responsible for any taxes, fees, mobile network charges, payment provider charges or other costs applicable to their use of the Services, except where such amounts are expressly included in the checkout price or required by applicable law to be collected and remitted by FanYield or its local collection entity.
Currency conversion rates, payment fees and Mobile Money charges may vary depending on the payment method and payment provider.
11. Subscription
11.1. Nature of Subscription
FanYield may offer Subscription plans that provide Users with certain access benefits, convenience features, Duel convenience benefits, monthly in-platform benefits, Draft Pack benefits, or other non-cash digital benefits described on the Platform from time to time.
Subscription benefits are intended to provide convenience, flexibility and access to selected in-platform features. A Subscription does not guarantee any fantasy result, Duel win, FanBux award, ELO rating, leaderboard position, Tournament ranking or Promotional Reward.
A Subscription does not provide any direct scoring advantage in free-to-play Tournaments and does not increase scoring, ranking calculation or prize eligibility. Fantasy results depend on User decisions, lineup selection, player selection strategy, football knowledge and real-world player performance according to FanYield's pre-defined scoring rules.
Subscription fees are not deposits, betting stakes, gambling stakes, wallet top-ups, money transfers, investments or payments for cash-out rights.
11.2. Price and Billing Period
Current Subscription prices and available billing periods (in particular, monthly and annual) are displayed on the relevant page of the Platform at the time of order. Prices are inclusive of VAT where applicable.
11.3. Automatic Renewal
Unless otherwise stated at checkout, Subscriptions renew automatically at the end of each billing period at the then-current price published on the Platform, until cancelled in accordance with Section 11.5.
11.4. Price Changes
FanYield may change Subscription prices. Price changes will be notified to the User by email at least thirty (30) days before the effective date. If the User does not agree with the change, the User may cancel the Subscription at any time before the effective date; continued payment at the new price constitutes acceptance of the change.
11.5. Cancellation
Users may cancel their Subscription at any time through account settings or by contacting FanYield support. Cancellation takes effect at the end of the current paid billing period; until then, the User retains access to Subscription benefits. Amounts already paid for the ongoing billing period are non-refundable, subject to Section 11.6.
11.6. Refunds and Right of Withdrawal (EU Consumer Law)
Subscription benefits constitute digital content and a digital service supplied immediately upon payment. By activating a Subscription, the User expressly consents to the commencement of performance before the expiry of the fourteen (14)-day withdrawal period under § 1837(l) of the Czech Civil Code (Act No. 89/2012 Coll.) and acknowledges that, as a result, the right of withdrawal under § 1829 of the Czech Civil Code is forfeited. Save where mandatory applicable law requires otherwise, Subscription payments are non-refundable.
11.7. Suspension or Termination of Account
If a User account is temporarily or permanently suspended under Section 18, the User is not entitled to any refund of Subscription fees. A Subscription automatically terminates upon permanent termination of the User account.
12. Fantasy Tournaments
12.1. Fantasy Gameplay Basics
FanYield Fantasy consists of skill-based fantasy sports tournaments based on the real-life performance of professional football players ("Tournaments"). Tournaments are accessible from a designated section of the Platform at fanyield.io/squads or any successor URL ("Lobby").
The main prize-bearing Fantasy Tournaments are free to play. No purchase of FanBux, Subscription, Draft Packs or Collectibles is required to participate in such free-to-play Tournaments.
Users may assemble a fantasy lineup using their own Collectibles and, where made available by FanYield, Loan Players. Loan Players are intended to allow Users to participate in selected Tournaments without necessarily acquiring Collectibles.
The goal is to build the highest-scoring fantasy lineup and compete with other Users based on the real-world performance of selected players according to FanYield's pre-defined scoring rules.
Users do not bet on the outcome of any football match, team result, player result or sporting event. Tournament outcomes are determined by fantasy scoring rules and lineup decisions, not by betting odds or wagering.
Each Lineup must include the number and type of players specified in the applicable Tournament rules. FanYield may determine the number, frequency, format and rules of Tournaments at its discretion. Winners and top participants may receive FanBux or Promotional Rewards as described in the Lobby or applicable Tournament rules.
12.2. Special Tournament Rules
Each Tournament may have special rules, including:
different formations;
different counts of Collectibles required per position;
different Fantasy rewards;
different reward distribution rules;
a maximum number of lineups per User per Tournament.
12.3. Eligibility
To participate in a Tournament, You need a valid FanYield account. Participation is prohibited if it would breach these Terms.
12.3.1. Eligible Collectibles. To assemble a Tournament lineup, You need a sufficient quantity of Collectibles issued from the Collectible Issuance Pool, unless Loan Players are made available.
12.3.2. Entry Window. To enter a Tournament, Users must lock in their lineup before the start of the last match of the Tournament. The period between Tournament announcement and start of the last match is the entry window ("Entry Window").
12.4. Scoring and Winning
12.4.1. Scoring System. Points are awarded for each player Collectible in a lineup based on third-party data regarding the player's real-world performance during the Tournament period. More information is available in the Support Center.
12.4.2. Winner. The winner is the User whose lineup accumulates the most points by the end of the Tournament period. In some Tournaments, rewards are also awarded for other positions. Winners are notified through their account. Participant usernames may be shown on the Platform.
12.4.3. Tiebreakers. Unless otherwise stated in the Fantasy Rules, in case of a tie, the User whose lineup included the Collectible with the highest individual score is ranked higher. If still tied, the User whose lineup was submitted first prevails.
12.4.4. Delayed Scoring. Due to circumstances beyond FanYield's control, FanYield may not receive player statistics from the data partner in real time. If FanYield does not receive complete statistics before scoring closes for a Tournament (as displayed on the Platform), You acknowledge that a limited set of statistics will be used to determine the final score. See the Support Center for details.
12.5. Fantasy Rewards and Promotional Rewards
Rewards available in connection with Tournaments, Duels, leaderboards or promotional campaigns may include FanBux, partner vouchers, physical items, hotel stays, apparel, nutritional products, digital goods or other non-cash Promotional Rewards.
Promotional Rewards are non-cash promotional benefits. They are not cash prizes, betting winnings, gambling winnings, cash equivalents, e-money, financial instruments, deposits, wallet balances or withdrawable funds.
No cash alternative is available for any Promotional Reward unless FanYield expressly states otherwise and such alternative is permitted by applicable law.
FanBux awarded as rewards remain subject to Section 3 of these Terms. They cannot be withdrawn, redeemed, exchanged, sold back or converted into fiat currency or cash.
FanYield may require Users to provide reasonable information necessary to verify eligibility, prevent fraud, comply with applicable law, arrange delivery, or provide the relevant Promotional Reward. FanYield may withhold, substitute or cancel a Promotional Reward if the User is ineligible, breaches these Terms, commits fraud, uses multiple accounts, manipulates gameplay, abuses referrals, or fails to provide required information.
12.6. Disqualification and Fraud
FanYield reserves the right to disqualify any User who does not comply with, or is reasonably suspected of not complying with, the Fantasy Rules, these Terms or any applicable Supplemental Terms. Any breach of the Fantasy Rules, these Terms or any applicable Special Tournament Rules will result in immediate disqualification and may trigger further service restrictions as set out in these Terms.
13. Duels
13.1. Duel Overview
FanYield may offer Duels, which are one-on-one skill-based fantasy sports contests between Users. Duels are based on the real-world performance of selected football players according to FanYield's pre-defined scoring rules.
Users do not bet on the outcome of any real-world football match, team result, player result or sporting event. A Duel is not a bet, wager, gambling product, casino product, lottery, cash contest or cash-out product.
13.2. Duel Lineups
Users may assemble Duel lineups using their own Collectibles and, where made available by FanYield, Loan Players. Loan Players are intended to allow Users to participate in selected Duels without necessarily acquiring Collectibles.
13.3. FanBux Participation Credit
A Duel may require the use of FanBux as an internal in-platform participation credit. Unless otherwise specified in the applicable Duel rules, a standard Duel may require one (1) FanBux to participate and may award two (2) FanBux to the winning User.
FanBux used or awarded in Duels are closed-loop virtual credits only. They are not cash, cash equivalents, e-money, deposits, betting stakes, gambling winnings, financial value or withdrawable funds.
13.4. ELO Rating
Duels may affect a User's ELO rating or similar skill-based rating system. ELO rating is determined by Duel outcomes and the applicable rating rules, not by the amount of FanBux purchased, held, used or awarded.
Playing more Duels does not guarantee a higher ELO rating. Losing Duels may decrease a User's ELO rating.
13.5. No Pay-to-Win
Purchasing FanBux, subscribing to FanYield, holding more FanBux, participating in more Duels, or acquiring higher-priced Collectibles does not guarantee Duel success, better player performance, higher ELO rating, higher leaderboard position, FanBux awards or Promotional Rewards.
The performance of football players is uncertain. Users may achieve better results through skillful selection of lower-priced, less popular or undervalued players.
14. Your Information, Content, and Feedback
14.1. Your Information
Please keep Your account information up to date. Subject to legal or regulatory requirements, We may request additional information from time to time and will contact You through Your account or email.
14.2. Your Content
You grant, or agree to grant, FanYield a transferable, sublicensable, royalty-free, unrestricted right to use, copy, distribute, adapt, create derivative works of, reproduce, publicly distribute, modify, translate and otherwise exploit any content You create through use of the Services (including username, comments, lineup compositions, team names, etc.) ("Content"), through any current or future process and any distribution channel on the Platform, social media (e.g., TikTok, Facebook, X, Instagram, Reddit) or platforms (e.g., YouTube), email banners, newsletters or internal documentation, in whole or in part, as provided or modified, for commercial or promotional purposes.
14.3. Feedback
Users may leave feedback or reviews via social media or [email protected]. By providing feedback, the User agrees that FanYield may publish and use it freely on the Platform, social media or other platforms.
15. FanYield Content
15.1. Proprietary Content
The Platform and Services, including their proprietary content, information, design, logos, text, graphics, images, icons, data, software, algorithms and scripts, are and remain the proprietary property of FanYield ("Proprietary Content").
15.2. Nothing in these Terms shall be construed as granting any ownership right, license, patent or other right in the Proprietary Content. You may not download, copy, imitate, use, distribute or otherwise publish or commercialize, in whole or in part, any Proprietary Content without FanYield's prior express written consent. You may not use Proprietary Content to promote third-party products or services without prior written consent. You also agree not to file, register or otherwise use FanYield trademarks or logos, or anything confusingly similar, in any jurisdiction without prior written consent for each specific use.
15.3. For the avoidance of doubt, acquiring a Collectible does not grant any ownership or other rights in Proprietary Content, Third-Party Collectible Elements, content, code, data or other materials.
16. Modification, Suspension, or Termination of Services
16.1. We reserve the right to modify, suspend or terminate, temporarily or permanently, part or all of the Services, products, offerings, promotions and features, and to introduce new ones. Modifications may occur for any reason including:
improvements to the Platform or Services;
necessary technical adjustments;
increase or decrease in User counts;
operational reasons, intellectual property obligations or claims, changes in third-party licenses, material cost changes, security improvements, or other material legal, regulatory, technical, marketing, product or security reasons.
16.2. To the fullest extent permitted by applicable law, You agree that any modification, suspension or termination of access may occur without prior notice and that FanYield is not liable for the consequences.
16.3. Inactive Accounts
We reserve the right, upon reasonable prior written notice, to delete any account that has been inactive for more than six (6) months.
16.4. Beta Testing
If a beta feature, product, service or offering is made available ("Beta Testing"), We reserve the right to modify, suspend or terminate Beta Testing at our sole discretion and without liability to You.
17. Prohibited Use of the Platform and Services
17.1. In connection with the Platform and Services, including Your account, lineups and the Marketplace, You may not:
17.1.1. create materials that are misleading or intended to defraud or confuse other Users;
17.1.2. create materials that are obscene, vulgar, offensive, threatening, defamatory, harassing, malicious, pornographic, or that violate the privacy or rights of any person, incite violence, racial or ethnic hatred, or that could constitute moral turpitude or incitement to commit crimes;
17.1.3. obtain or attempt to obtain unauthorized access to other Users' accounts or computer networks;
17.1.4. use or attempt to use another User's account;
17.1.5. impersonate FanYield staff;
17.1.6. use the Services or perform transactions in an effort to manipulate prices, defraud or engage in deceptive activity;
17.1.7. perform transactions that are suspicious, fraudulent or otherwise disrupt normal operation of the Services;
17.1.8. use the Services for betting, gambling, wagering, casino activity, lottery activity, money laundering, terrorist financing, sanctions evasion, fraud or any unlawful activity;
17.1.9. attempt to sell, purchase, exchange, redeem, withdraw or convert FanBux outside the FanYield Services;
17.1.10. attempt to use FanBux, Collectibles, accounts, rewards or Promotional Rewards as cash, cash equivalents, financial instruments, deposits, wallet balances or payment instruments;
17.1.11. abuse referrals, promotions, FanBux awards, Subscription benefits, Duels, Tournaments, rankings or Promotional Rewards;
17.1.12. create or use multiple accounts to gain unfair advantages, obtain additional rewards, manipulate ELO rating, manipulate the Marketplace or circumvent limits;
17.1.13. coordinate with other Users to manipulate Duel outcomes, Tournament results, Marketplace prices, rankings, FanBux balances or rewards;
17.1.14. initiate abusive chargebacks, payment reversals or refund claims after receiving FanBux, Draft Packs, Subscription benefits, Collectibles or other digital Services;
17.1.15. use automated tools, bots, scripts or coordinated account activity to gain unfair advantages.
17.2. You further may not:
17.2.1. access or attempt to access non-public parts of the Platform;
17.2.2. interfere with access restrictions, prevent other Users from using the Services, or disrupt, congest or overload the Platform;
17.2.3. use bots, web spiders or automated means to access or scrape the Platform, or frame or mirror any part of the Platform;
17.2.4. use any data-mining or extraction methods, or otherwise collect information about FanYield, the Services or their Users in breach of these Terms;
17.2.5. send unsolicited emails, spam, chain letters, phishing emails, malware, ransomware or advertising of any kind;
17.2.6. probe, scan, compromise or test the vulnerability of the Platform, Services, any system or network, or bypass any security or authentication;
17.2.7. modify, adapt, translate, reverse-engineer, decompile or disassemble any part of the Platform or Services, or create derivative works;
17.2.8. sell, sublicense, lease, rent, offer or otherwise commercialize any FanYield offering, product or feature, or infringe FanYield's intellectual property;
17.2.9. use data collected from the Services for any commercial activity;
17.2.10. violate any applicable laws or rules (including these Terms and any Supplemental Terms);
17.2.11. remove or alter any copyright, trademark, confidentiality or other proprietary notices on the Platform;
17.2.12. use the Platform for any unlawful or unauthorized purpose, including money laundering or other illegal financial activity.
18. Unusual Activity and Breach
18.1. Unusual Activity
18.1.1. Reporting. We welcome reports of fraudulent or unlawful activity by other Users. FanYield reserves the right at its sole discretion to investigate accounts suspected of irregularity and restrict access or temporarily suspend accounts during such investigation. Reports may be made to [email protected] and will be treated as confidential, except where disclosure is required by applicable law or a competent authority.
18.1.2. Investigations. FanYield reserves the right to investigate accounts suspected of irregularity and to restrict access or temporarily suspend any account during investigation, including upon reports from other Users.
18.2. Breach
You may not use the Platform, Services or Your account in a manner that breaches these Terms or any Supplemental Terms. FanYield reserves the right to restrict Services for a User account, temporarily suspend an account, or permanently suspend an account where a User is suspected of, or has actually committed, a breach.
18.2.1. Tournament/Duel Ineligibility. We reserve the right to temporarily exclude You from Tournaments or Duels, or remove You from any Tournament or Duel, if You have breached or are suspected of breaching these Terms. In such cases, We may withhold or deny any reward.
18.2.2. Account Suspension. We reserve the right to suspend, temporarily or permanently, Your account from all or part of the Services where You have breached or are suspected of breaching these Terms.
18.3. Appeals
If We take action under this section, You may appeal by contacting [email protected] and providing: Your name, username, email address, details of the issue, and any previous FanYield response. We will investigate and respond as soon as reasonably possible.
18.4. Consent
You agree and acknowledge that FanYield has no liability to You for action taken in good faith under this section. To the fullest extent permitted by applicable law, You will not sue or seek compensation from FanYield in connection with such actions.
19. Indemnification
19.1. To the fullest extent permitted by applicable law, You will indemnify FanYield, its agents, consultants, contractors, shareholders, employees, successors, beneficiaries, directors, partners, subsidiaries, suppliers and licensors against any claims, liabilities, damages, awards, judgments, losses, costs (including reasonable attorneys' fees) and expenses arising from:
Your breach of these Terms;
Your breach of the Fantasy Rules or any Supplemental Terms;
Your use or misuse of the Services;
Your breach of third-party rights, including any rights related to Third-Party Collectible Elements and other Users;
Your breach of any applicable law; and/or
Your negligence, gross negligence or willful misconduct.
19.2. To the fullest extent permitted by applicable law, You agree and acknowledge that FanYield will not indemnify You for any claims, damages, liabilities, awards, judgments or losses related to Your use of the Platform or Services.
20. Liability
20.1. General
To the fullest extent permitted by applicable law, FanYield, its agents, consultants, contractors, shareholders, employees, successors, beneficiaries, directors, partners, subsidiaries, suppliers and licensors disclaim all liability arising from or in connection with the Platform or Services. We are not liable for:
Your reliance on any statement, information or data available on the Platform, Services or any social media platform or blog operated by FanYield;
loss of user content, data or Collectibles;
any events occurring during trading of Collectibles affecting price, design, or any temporary or permanent account suspension;
direct or indirect damages arising from use of the Platform or Services by You or any third party;
interruptions to the Platform or Services and any losses caused by errors, breaches or malfunctions;
Third-Party Services;
failures or cyberattacks;
any force majeure event;
any malware or other harmful elements that may be contained in the Platform or Services.
20.2. You understand and accept the risks of internet-based services and experimental technologies such as digital sports Collectibles, and agree that FanYield will not be liable in any way for failures of such technologies or security breaches.
21. Assumption of Risk and Disclaimer
To the fullest extent permitted by applicable law, Your use of the Platform and Services is at Your own risk. FanYield expressly disclaims all warranties of any kind and all liability. FanYield does not warrant that: (a) the Services will meet Your requirements; (b) the Services will be uninterrupted, timely, error-free, or free of harmful elements or malware; (c) any results obtained through use of the Services (including any data shown) will be accurate or reliable; (d) the quality of any products, services, information or materials obtained through the Services will meet Your expectations.
To the fullest extent permitted by applicable law, FanYield disclaims all liability for any loss You may incur through use of the Platform, Services, FanBux or Collectibles.
21.1. Entertainment-Only Nature
FanBux and Collectibles are in-platform entertainment features only. They are not investments, securities, financial instruments, e-money, deposits, wallet balances, betting stakes, gambling winnings, cash equivalents or payment instruments.
Marketplace prices for Collectibles may change based on in-platform User activity, supply and demand, fantasy interest and other entertainment-related factors. FanYield does not guarantee that any Collectible can be sold, exchanged or used at any particular in-platform price or at any particular time.
Users acquire Collectibles for personal entertainment and fantasy sports use only, not for investment purposes or with any expectation of profit, liquidity, financial return or cash-out.
21.2. Records and Internet Reliance
The Platform does not store, send or receive Collectibles in the manner of a custodial wallet. Collectibles exist only through ownership records maintained in event-driven databases managed by the Platform. Transfers of Collectibles occur within the Marketplace.
FanYield relies on internet-based services and acknowledges that disruptions, delays or outages in connectivity may occur and may affect availability and functionality.
21.3. Third-Party Services
FanYield may use or link to Third-Party Services. Your access to and use of Third-Party Services may be subject to additional terms, privacy policies and agreements of those third parties, and may require separate account verification or creation. Some Third-Party Services give FanYield access to information You provide. Reliability and security of Third-Party Services is outside FanYield's direct control. FanYield is not responsible for Third-Party Services, including accuracy, availability, reliability or completeness of information, or third-party privacy practices. Any transactions You have with third parties using the Services are between You and the third party. FanYield will not be directly or indirectly liable for damages or losses caused by reliance on Third-Party Services.
21.4. Data Security
Despite the use of standard security measures, internet services are subject to data breaches, hacking or unauthorized access. You acknowledge the risks of transmitting information over the internet. You are responsible for confidentiality of Your password and account details, and bear full responsibility for all activity under Your account. You agree to (a) promptly notify FanYield of any unauthorized use or security breach, and (b) ensure You log out at the end of each session. FanYield will not be liable for losses arising from breach of this section.
To the fullest extent permitted by applicable law, You acknowledge that FanYield is not liable for any communication failures, interruptions, errors, distortions or delays in internet-based services in connection with the Platform.
22. Account Cancellation and Termination
22.1. Cancellation by User
22.1.1. You may terminate these Terms at any time by requesting deletion of Your account and ceasing use of the Platform.
22.1.2. Deletion of Your account results in irreversible deletion of all user data associated with the account.
23. Modification of Terms
23.1. We reserve the right to amend these Terms at any time. Where We make material changes, We will notify You through the designated communication channel (e.g., email to the address linked to Your account) and provide reasonable advance notice. If You do not agree to the updated Terms, they will not bind You — meaning the Agreement will terminate, requiring deletion of Your account and ceasing use of the Platform. Continued use of the Platform constitutes acceptance of the updated Terms.
23.2. The currently effective version of these Terms is the latest version published on the Platform at the time of use of the Services.
24. App Store Terms
This Section 24 applies to access to or use of the FanYield mobile application obtained through Apple Inc.'s App Store (the "Apple App") and complements the rest of these Terms. In the event of conflict, this Section prevails for the Apple App only.
24.1. Acknowledgement
These Terms are concluded between You and FanYield only, and not with Apple. FanYield, not Apple, is solely responsible for the Apple App and its content.
24.2. Scope of License
The license granted to You for the Apple App is limited to a non-transferable license to use the Apple App on any Apple-branded products that You own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
24.3. Maintenance and Support
FanYield, not Apple, is solely responsible for providing any maintenance and support services for the Apple App, as required under these Terms or applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services.
24.4. Warranty
FanYield, not Apple, is responsible for any warranties to the extent not effectively disclaimed in these Terms. In the event of any failure of the Apple App to conform to any applicable warranty, You may notify Apple, and Apple will refund the purchase price (if any) for the Apple App; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Apple App.
24.5. Product Claims
FanYield, not Apple, is responsible for addressing User or third-party claims relating to the Apple App or User's possession and/or use of it, including: (i) product liability claims; (ii) any claim that the Apple App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation, including in connection with the Apple App's use of HealthKit and HomeKit frameworks (if any).
24.6. Intellectual Property
In the event of a third-party claim that the Apple App or User's possession and use of it infringes that third party's intellectual property rights, FanYield, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such claim.
24.7. Legal Compliance
You represent and warrant that: (i) You are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country; and (ii) You are not listed on any U.S. Government list of prohibited or restricted parties.
24.8. Developer Contact

24.9. Third-Party Beneficiary
You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms with respect to the Apple App, and that Apple has the right (and is deemed to have accepted the right) to enforce these Terms against You as a third-party beneficiary thereof.
24.10. In-App Purchases (Apple App)
[Flagged: this clause applies only if Apple In-App Purchase is enabled. If FanYield operates the Apple App on a "reader app" model with payments processed only via the Website, this clause may be omitted.]
Where the Apple App offers In-App Purchases, all such transactions are processed through Apple and subject to the Apple Media Services Terms and Conditions. Refunds, cancellations and billing for In-App Purchases are governed by Apple. To cancel an auto-renewing Subscription purchased via the Apple App, manage it in Your Apple ID account settings.
